The story of Ashley McClary — including her personal testimony, the hidden pregnancy, the adoption, the reunion, and the founding of AAP — is her exclusive intellectual and personal property. Any unauthorized use, reproduction, dramatization, adaptation, or exploitation of her personal story in any medium is strictly prohibited and will be aggressively prosecuted to the fullest extent of the law.

The name "Ashley Adoption Project," the AAP logo, all associated marks, slogans, and design elements are trademarks and service marks of Ashley Adoption Project, Inc. Nothing on this website grants any license or right to use any trademark, service mark, logo, or trade name of AAP without prior written permission. Any unauthorized use of AAP trademarks is strictly prohibited and constitutes trademark infringement subject to civil and criminal penalties under federal and state law.
Section 04
Certain information accessible through this website — including but not limited to strategic plans, financial projections, program frameworks, partnership structures, initiative designs, donor strategies, and organizational roadmaps — constitutes proprietary trade secrets of Ashley Adoption Project, Inc. protected under the Defend Trade Secrets Act (DTSA), 18 U.S.C. § 1836, and applicable state trade secret laws.
Any person or entity who misappropriates, discloses, uses, or attempts to exploit any trade secret of AAP will be subject to civil liability for actual damages, unjust enrichment, exemplary damages up to two times the actual damages, injunctive relief, and attorneys' fees, as provided by federal and state law.

Civil litigation for copyright infringement under the Copyright Act (17 U.S.C. § 101 et seq.), including statutory damages of up to $150,000 per willful infringement; trademark infringement claims under the Lanham Act; trade secret misappropriation claims under the Defend Trade Secrets Act (18 U.S.C. § 1836) and Florida Uniform Trade Secrets Act; claims for unjust enrichment and disgorgement of all profits derived from unauthorized use; injunctive relief requiring immediate cessation of infringing activity; compensatory and punitive damages; and full recovery of attorneys' fees and litigation costs.
AAP maintains legal counsel and will not hesitate to pursue all available remedies — in state court, federal court, or both — against any individual, organization, nonprofit, for-profit entity, or person acting in any capacity who violates these Terms.

Donations made through this website are processed securely via PayPal and are made to Ashley Adoption Project, Inc. All donations are used exclusively to advance the mission and programs of AAP. Ashley Adoption Project, Inc. is in the process of completing its 501(c)(3) tax-exempt status determination. Donors should consult their tax advisors regarding the deductibility of contributions. All donations are final and non-refundable except in cases of documented processing error.
AAP will never use donor information for any purpose other than organizational communications and required legal recordkeeping. Donor information will never be sold, shared, or disclosed to third parties except as required by law.

This website may contain references to or links to third-party organizations, individuals, programs, or resources. Such references do not constitute an endorsement, partnership, sponsorship, or affiliation by AAP unless explicitly stated. AAP is not responsible for the content, accuracy, or practices of any third-party website or resource. Any third party that claims affiliation with, endorsement by, or partnership with Ashley Adoption Project, Inc. without written authorization is in violation of these Terms and applicable law.

In any action brought by AAP to enforce these Terms, AAP shall be entitled to recover its attorneys' fees and all costs of litigation in addition to any other relief granted by the court.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ashley Adoption Project, Inc. regarding your use of this website.

Ashley Adoption Project, Inc. will pursue every legal remedy available — without exception — against any individual or entity that attempts to steal, copy, or exploit what has been built here.
